What is CCB with Shared Custody?

CRA treats shared custody as a tax and benefit question, not a private contract question. If the child lives with each parent at least 40% of the time, CRA may treat the arrangement as shared custody for CCB purposes.

Do I Qualify?

  • The child must live with each parent at least about 40% of the time
  • Both parents must individually meet the normal CCB eligibility rules
  • CRA focuses on actual living arrangements, not just private wording in an agreement
  • Accurate documents and consistent filings help if CRA reviews the claim

How Much Can I Get?

In shared custody, each parent generally receives 50% of the CCB amount CRA calculates for that parent based on that parent’s own family situation and income.

How to Apply

Report the shared-custody arrangement to CRA and be prepared to support it if asked. CRA may request documents showing the child’s real living pattern.

Frequently Asked Questions

What counts as 40% time with the child?

CRA looks at the real pattern of care and residence. It is not enough to simply say custody is shared if the child does not actually live with both parents enough of the time.

Can both parents claim the full CCB?

No. In shared custody, CRA generally splits entitlement so that each parent receives 50% of that parent’s own calculated amount.

What if my ex will not cooperate with CRA?

CRA can still review the case based on tax filings and supporting evidence. Keep records that show the real parenting schedule and child residence pattern.
